More Privacy Rights Erosion: Hudson v. Michigan

Scalia, writing for majority, asserts that violation of the exclusionary
rule ("knock and announce") by police is not enough to suppress evidence
found pursuant to a valid search warrant.  In eviscerating decades (at
least) of 4th Amendment jurisprudence on the matter, the venerable
Justice offers two rationales: (1) plaintiff must show that the interest
the constitutional right serves is directly advanced by suppressing
evidence found in violation of the right; and much more unbelievably,
(2) police are likely to be deterred from constitutional violations
because of the availability of 1983 civil rights violations damages
remedies (including the right to attorney's fees), the professionalism
of police forces, and the presence of community review boards!  The
latter rationale is even more laughable once you look back only last
month to Ceballos.
